Penalties for late payment - mandatory?

I’m aware that invoices have to contain the following types of clauses about late payment:
‘Tout incident de paiement est passible d’int茅r锚ts de retard. Le montant des p茅nalit茅s r茅sulte de l’application aux sommes restant dues d’un taux d’int茅r锚t l茅gal en vigueur au moment du sinistre.
Indemnit茅 forfaitaire pour frais de recouvrement dus au cr茅ancier en cas de retard de paiement: 40 鈧�’

Is it mandatory that the auto-entrepreneur has to impose these penalties if a client pays late? Or is it optional on the part of the auto-entrepreneur?
